Marketing Window is operated by Next Collective LLC, a Wyoming limited liability company ("we", "us"). These terms cover your use of Marketing Window: our library of public ads, and our creative studio, where you order images and videos for your own products and pay with credits. They also include how credits, cancellations and refunds work, and our acceptable use rules, so everything is in one place. By creating an account, you agree to these terms. We've kept them short and plain. If anything is unclear, ask us before you rely on it.
Using the service
Marketing Window is built for businesses. You can search public ads, track brands, save ads to your swipe file and boards, and order images and videos for your products from our studio.
- You must be 18 or over and able to enter into a contract.
- If you sign up for a company or a client, you confirm you're allowed to accept these terms for them. "You" then includes that organisation.
- Research and inspiration, not copying. You can use the library to study what's working and to make original ads for your own products. You can't use it to copy other brands' ads.
- The acceptable use rules below are part of these terms. Please read them.
- Our privacy policy and cookie policy explain how we handle personal data.
Accounts and workspaces
- You sign in with your email address and a password, or with Google.
- Keep your password and your email account secure: anyone who can open your inbox can reset your password. Tell us straight away if you think someone else has access.
- Your account belongs to a workspace. The workspace owner invites members, sets their roles and manages billing. If your employer set up the workspace, they control it.
- Members share the workspace's swipe file, tracked brands, Library and credits. Editors can spend credits; viewers can look and download.
- Each paid seat is for one named person. Don't share a login between several people.
Plans and billing
- We offer paid Pro and Team plans, and every new account starts with a free trial of one of them. Workspaces that were already on our Free plan keep it. Agencies can talk to us about larger plans. What each includes, and what it costs, is on our pricing page. Prices are in US dollars. Taxes are added at checkout where required.
- Renewal. Paid plans renew automatically each month or each year, depending on the billing period you choose. We charge the payment method on file at each renewal.
- Cancel any time. Cancelling stops the next renewal. You keep your paid features until the end of the period you've paid for. Your first annual plan can be refunded pro-rata within 30 days; after that, and for renewals, it runs to the end of the year. Cancellations and refunds has the details.
- Price changes. We may change our prices. If a change affects your plan, we'll email you before it applies, and it will only take effect from a renewal after that notice. You can cancel before then.
- Limits. Plans include limits, such as tracked brands, seats, products in your brand kit and how many orders you can have open at once. Unlimited features are for normal use by the people on your plan, not for automated or bulk use.
- Failed payments. If a payment fails, we'll let you know and try again. If it still fails, we may pause paid features until it's sorted.
Free trials and auto-renewal
- One trial. Each person and each workspace can have one free trial. We may offer more trials, or longer ones, at our discretion.
- What a trial includes. The plan you choose (Pro or Team) for the length shown when you start it, currently 7 days, with that plan's features and a set of trial credits. Trial credits end when the trial ends.
- A reminder. We email the workspace's owner and admins 2 days before the trial ends.
- Cancel any time. You can cancel the trial from Credits & billing in the app. It then runs to its end date, and you won't be charged.
- When it ends. If you gave a card when you started, your plan starts when the trial ends: we charge that card for the first month or year you chose, and the plan then renews automatically as plans and billing describes, until you cancel. Until card payments open, we don't take a card: when a trial ends, your workspace becomes read-only until you choose a plan. Your saved ads, boards, tracked brands and files are kept, and you can still download what you made.
- Changes to trials. We may change or end our free trial offers for trials that haven't started. A trial you've started runs as it was described when you started it.
Credits
Ordering an image or a video costs credits. Each format shows its price in credits, and its usual delivery time, before you order.
- Where credits come from. A free trial comes with trial credits, which end when the trial ends. Accounts on our Free plan got a one-time set of credits when their email was confirmed. Paid plans add credits every month. You can also buy credit packs. Staff may add credits, for example to make up for a problem.
- How long they last. Each month's plan credits last for the number of months your plan says, so unused credits roll over up to that limit. Pack credits last 12 months from purchase. We use plan credits first, oldest first, then pack credits.
- Held, then used. When you place an order, we hold the credits it costs. We take them when we deliver. If we can't make your order, or can only deliver part of it, the credits for what we didn't deliver come back to you automatically. If you cancel an order before we start work on it, all of its credits come back.
- Rush. Rush costs extra credits, shown before you order. If we deliver a Rush order after its Rush delivery date (not counting business days we spent waiting for an answer from you), the extra Rush credits come back to you automatically.
- Prices can change. The credits a format costs may change. The price shown when you place an order is the price you pay for that order.
- Changing plans. If a workspace moves to the Free plan (where it still has one), plan credits end when your paid period ends. Pack credits stay until they expire.
- No cash value. Credits aren't money. You can't sell or transfer them, swap them for cash, or move them to another workspace, except as cancellations and refunds describes or the law requires.
- Test orders. While we open ordering in stages, some workspaces place test orders. Test orders come back with Example files, which are for trying the product, not for publishing.
Orders and delivery
- Your brief. Tell us what you want as clearly as you can, and make sure what you give us (product details, prices, claims, photos, logos and other files) is accurate and yours to use. We make what your brief asks for, using your Brand kit.
- Questions. If something in your brief is unclear, we'll ask in the order's messages. While we wait for your answer, the delivery date moves out by the business days we waited.
- Delivery dates are estimates. Each format shows its usual delivery time in business days, and your order shows a date. We work hard to meet it, but it's an estimate, not a guarantee, apart from the Rush credits described in credits.
- Who makes it. Our team makes every order, sometimes with contractors who work for us under confidentiality obligations, and with the tools that suit the job, including AI tools. A person checks every order before we deliver it.
- Changes. Each order includes one free round of changes, which you can ask for within 7 days of delivery. Changes must fit the brief you sent. A new idea, a new product or a new format is a new order.
- We may decline. We may decline an order, or part of one, for example if it breaks the acceptable use rules or a platform's advertising policies, or if we can't make it to our standard. We'll tell you why where we can, and the credits for anything we don't deliver come back to you.
- Delivery. We deliver files to your Library, where they stay while your account is open.
Messages
- Each order has a message thread between your workspace and our team. Please keep it about the order.
- We keep messages with the order, and we may read them to make your order, to support you and to resolve disputes. Our team's internal notes on an order aren't shown to you.
- Don't send passwords, payment details or other people's personal information in messages unless an order needs it.
Ad data and Signal
- Ads in the library come from public ad libraries run by Meta, TikTok, Google and LinkedIn. We link each ad to its source.
- The data may be incomplete. Platforms don't publish every ad, and what they publish varies by country. We show a coverage label for each platform and country. Ads can be missing, late or wrong, and a brand's history starts on the day we began tracking it.
- Signal is an estimate, not spend. Signal is a score from 0 to 100 that we calculate from what we can see, such as how long an ad has run and how many variants it has. It isn't spend, reach or performance data, and it can be wrong. Days running, variants, transcripts and AI breakdowns are our best reading of public information, not facts supplied by the advertiser.
- The ads belong to their owners. Seeing an ad here doesn't give you any right to reuse it.
- Rights holders and people who appear in ads can ask us to remove them. See takedown requests.
Your content and ours
- Your content. You own what you put into Marketing Window, such as notes, boards, your brand kit, product photos and other uploads, and the briefs and scripts you write. You let us host, copy and process it only to run the service for you, including making what you order. You're responsible for having the rights to it.
- Share links. Anyone with a board's share link can see that board until you turn sharing off.
- AI features. Transcripts, AI breakdowns, brand summaries and the writing help in briefs use AI, and AI can get things wrong. Check anything important before you rely on it.
- Our content. The software, design, Signal scores, tags, summaries and the way we organise the library belong to us or our licensors. While your account is active, we give you a personal, non-transferable right to use them for your own business research, within your plan. Ads you download from the library are for your own internal use.
- Feedback. If you send us ideas or suggestions, we can use them without owing you anything.
What we make for you
These terms apply to the images, videos and other files we deliver for your orders ("deliverables").
- You own your deliverables. As between you and us, the deliverables are yours once delivered, and we assign to you whatever rights we, our staff and our contractors have in them. You can use them commercially for your own brand, in ads, on your store and anywhere else your brand appears.
- AI and copyright. Parts of a deliverable may be made with AI tools. In some countries, material made by AI may not be protected by copyright, and someone else could make something similar. We can't promise that every part of a deliverable is unique or that you can stop others using something similar.
- Reference ads are a blueprint, not a source. When you start from an ad in the library ("Make my version"), we use its structure, such as the kind of hook, the pacing and the order of shots. We don't use the ad's images, footage, logos, words or people. Your version uses your product, your brand and your words.
- Our characters. The characters in our cast are people or digital people we're licensed to use in your ads. Example characters, shown with an Example tag, are stock photos for test orders only. Don't present any character as a real customer or a genuine review. Testimonial-style videos carry an on-screen "Dramatisation" label unless you confirm the words come from real customer feedback you can show.
- Your own character. If you ask us to make a character from photos of a real person, you confirm that the person is you, or that they've given you written permission to use their likeness in ads; that they're 18 or over; and that they're not a celebrity or public figure. We keep that confirmation, with the time you gave it, with the order, and we may ask to see the permission. You can delete the character at any time, which deletes its files.
- Your claims. You're responsible for what your ads say, such as prices, results or health benefits, for your product being lawful to advertise, and for following platform rules and advertising laws when you publish.
- Disclosure. When AI tools were used to make part of a deliverable, it comes with a note saying so, and we keep a production log for every order. Meta, TikTok and Google may label AI content. You're responsible for disclosing AI use where the law or platform rules require it.
- Safety checks. We check what you send us, and what we deliver, for safety, and we may refuse to make, or remove, anything that breaks the acceptable use rules. If we stop an order, the credits for anything we didn't deliver come back to you.
- Your inputs. We use your product photos, brand kit, files and briefs to make what you order. We don't use them to train AI models, and we only use tool providers that agree not to train on them.
- Keep copies. Your files stay in your Library while your account is open. Please download anything you want to keep.
Cancellations and refunds
This section explains how cancellations and refunds work for subscriptions and credits. We want it to be fair and easy to follow. If your situation isn't covered here, talk to us. Nothing here limits your rights under consumer law.
Subscriptions
- Cancel any time. You can cancel a paid plan at any time from Credits & billing in the app, or by emailing us. Cancelling stops the next renewal.
- An offer to stay. When you cancel a monthly plan or trial, we may offer you a discount once. If you take it, it applies to the number of monthly payments we show you and then ends by itself, and your plan carries on at its usual price. Changing plans ends the discount. You can still cancel at any time, and saying no to the offer doesn't change anything else.
- Monthly plans stop at the end of the billing period. You won't be charged again, and you keep your paid features until the period ends. We don't refund part-months, except where the law requires it or we've made a mistake.
- Your first annual plan can be refunded pro-rata within 30 days of buying it. If you cancel in that time, we refund the unused part of the year. After 30 days, your plan runs to the end of the year and then stops. You keep your paid features until then.
- Annual renewals aren't refunded once they've started, except where the law requires it or we've made a mistake. We'll email you before an annual plan renews, so you can cancel first.
- Changing plans. When you change plans, we'll show you the price and when the change takes effect before you confirm.
- Billing mistakes. If we charge you twice or charge you in error, we'll refund the mistake in full.
- Free trials and the Free plan. These cost nothing, so there's nothing to refund. A trial you cancel isn't charged. You can close your account at any time.
Credits and credit packs
- Orders we can't make. If we can't make an order, or can't deliver part of it, the credits for what we didn't deliver come back to your balance automatically. You don't need to ask. The same goes for an order you cancel before we start, and for the Rush credits on a late Rush order.
- Credit packs. If you haven't used any credits from a pack, you can ask for a refund within 14 days of buying it. After that, or once you've used some of its credits, packs aren't refundable, except where the law requires it or we've made a mistake.
- Plan credits come with your plan. They aren't refunded on their own, and they end as credits describes.
- If a format stops. If a format stops being available while your order is open, or we can't finish it for reasons on our side, the credits for anything we didn't deliver come back to you.
How to ask for a refund
- Subscriptions. Cancel from Credits & billing, or email us with your workspace name.
- Credit packs. Email us with your workspace name and when you bought the pack.
- We'll reply as quickly as we can and explain what we can offer before anything changes.
- Refunds go back to the payment method you used, in US dollars, the currency you paid in. Your bank may take several business days to show it. We can't control exchange-rate changes or fees your bank charges.
- If something's gone wrong, please contact us before you raise a dispute with your bank. It's usually faster to sort out directly.
Your consumer rights
Nothing in these terms excludes rights that can't be excluded under consumer law where you live, such as the consumer guarantees under the Australian Consumer Law.
- Under the Australian Consumer Law, services come with guarantees that they'll be provided with due care and skill, fit for any purpose you told us about, and delivered within a reasonable time. If there's a major failure, you may be entitled to cancel and get a refund. For a minor failure, we'll fix it within a reasonable time.
- If you're a consumer in the UK or EU, you may have a right to cancel within 14 days of buying. If you ask us to start providing the service in that time, for example by placing an order, you may lose that right for what you've already used.
- Marketing Window is designed for businesses, and some of these rights may not apply to business purchases. Where they do apply, they come first.
Acceptable use
These rules explain how you can and can't use Marketing Window. They apply to everyone with an account, and to anyone who views a board shared with them. The short version is inspiration, not duplication: learn from other brands' ads, then make something that's your own.
Research use
The library is for research and inspiration. Good ways to use it include:
- studying what competitors and brands in your category are running
- spotting formats, hooks, angles, offers and trends
- saving ads to your swipe file and boards, with notes on why
- sharing boards with your team, your clients or people you work with
- making original ads for your own products, using an ad's structure as a starting point
Make your own version, not a copy. Take the idea behind an ad, such as its format, the structure of its hook or its pacing, and make it with your own product, words and visuals. "Make my version" is built for exactly this.
Ads you download from the library, and boards you share, are for your own work and the people you work with. Please don't publish them or pass them on more widely.
Prohibited use: data and access
You must not:
- scrape or crawl the service, or access it with bots, scripts, headless browsers or other automated tools, except through features we provide for that purpose
- bulk-download ads or media, or try to copy our library or any large part of it
- resell, license, redistribute or publish our data, Signal scores, transcripts or AI breakdowns
- use our data to build a competing product or dataset, or to train AI models
- get around plan limits, for example by opening several accounts to collect free trials or credits, sharing a login or rotating IP addresses
- access workspaces or share links that weren't given to you
- probe, scan or test our systems for weaknesses without our written permission, or do anything that interferes with the service
- copy, decompile or reverse-engineer our software, except where the law allows it
- use information about people who appear in ads to identify, contact, profile or harass them
If you find a security problem, please tell us rather than testing it further.
Prohibited use: content and ads
You must not use Marketing Window to:
- re-upload other brands' ads as your own, run them, or pass them off as yours
- make close copies of another brand's creative, copy, characters, footage, music or trademarks
- upload material you don't have the rights to, such as product images, logos, label art, footage, music or someone's likeness
- upload photos or video of real people, or order anything that looks like a real, identifiable person, without their permission
- order deceptive ads, such as characters posing as real customers, fake testimonials or reviews, invented results or before-and-after images, or fake endorsements
- impersonate real people, celebrities or brands
- make false or misleading claims about products, prices, health effects or results
- hide AI involvement where the law or platform rules require you to disclose it
- advertise regulated products, such as alcohol, supplements or financial products, without following the rules that apply to them
- create or promote anything unlawful, including scams, illegal products, sexual content, hateful or harassing content, content that sexualises minors, or material that infringes someone else's rights
We may decline or stop any order that we think breaks these rules or a platform's advertising policies. What we make for you explains how characters, testimonials and disclosure work.
Enforcement
If someone breaks these rules, we'll respond in proportion to how serious it is. We may:
- warn you and ask you to stop
- remove content or deliverables, or turn off share links
- limit features or apply stricter rate limits
- decline orders or freeze a workspace's credits
- suspend or close the account
Where we reasonably can, we'll tell you what the problem is and give you a chance to fix it first. We may act straight away, without notice, if the problem is serious, if the law requires it or to protect other people or the service. We may also report unlawful activity to the relevant authorities.
We block automated access, and we may block IP addresses or accounts that try to scrape the service.
If we close an account for breaking these rules, cancellations and refunds covers any fees you've paid, and your rights under consumer law still apply.
If you think we've made a mistake, email us and we'll review our decision.
Reporting
Help us keep Marketing Window fair and safe.
- Misuse. If you see someone scraping the service, sharing boards in breach of these rules, or using what we made in a deceptive way, email our support team.
- Your ad, or you in an ad. If an ad in our library uses your work, or shows you, and you'd like it removed, follow our takedown process.
- Security issues. Email our support team with "Security" in the subject line. Please don't access other people's data or disrupt the service while you investigate.
We review every report. For privacy reasons, we may not be able to tell you exactly what action we took.
Suspension and closing your account
- We can suspend or close accounts that scrape, bulk-download or resell our data, copy other brands' ads, break the law or the acceptable use rules, don't pay, or put the service or other people at risk.
- Where we reasonably can, we'll warn you first and give you a chance to fix the problem. We may act straight away if the problem is serious or the law requires it.
- You can close your account at any time by emailing us. Cancel any subscription first, and download anything you want to keep from your Library.
- Open orders. If an account is suspended or closed while orders are open, we stop work on them and return their held credits, unless we closed it for a serious breach of these terms, in which case cancellations and refunds and consumer law decide what you get back.
- When an account closes, we delete or anonymise its data within a reasonable period, unless the law requires us to keep it. Unused credits end when the account closes. Your rights in deliverables we made for you continue after your account closes.
Liability and changes
- Consumer law comes first. Nothing in these terms excludes rights that can't be excluded under consumer law where you live, such as the consumer guarantees under the Australian Consumer Law. If you use Marketing Window as a consumer rather than as a business, you may have extra rights, and these terms don't take them away.
- Provided as is. Apart from those rights, we provide Marketing Window as it is. We work hard to keep it accurate and available, but we don't promise it will be complete, error-free or always online, that every deliverable will be exactly what you hoped for (that's what the free round of changes is for), or that it will get particular results for your ads.
- Limits. To the extent the law allows, we're not liable for indirect or consequential loss, lost profits or lost data. Our total liability for all claims about the service is limited to the greater of what you paid us in the 12 months before the claim or US$100. For a single order, our liability is also limited to giving back the credits it used.
- Consumer guarantees. Where the law lets us limit our liability for breaching a consumer guarantee, we limit it to supplying the service again or paying the cost of having it supplied again.
- These limits don't apply to liability that the law doesn't allow us to limit, such as liability for fraud, or for death or personal injury caused by our negligence.
- Changes to these terms. We may update these terms as the product changes. For important changes, we'll tell you by email or in the app before they take effect. If you keep using Marketing Window after that, the new terms apply. If you don't agree, you can cancel.
Governing law
- These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules.
- If a dispute comes up, please contact us first. Most problems are faster to sort out directly, and we'll try to resolve it with you within 30 days.
- If we can't, the state and federal courts located in Wyoming have jurisdiction, and you and we agree to submit to them.
- If you're a consumer, you keep the protection of any mandatory laws of the country where you live, and you can also bring a claim in your local courts.
